Denial and Unsigned IME

Has anyone come across a case where applicant contends the denial is defective due to the IME being dated and signed after the denial was issued? Ex: IME held 10/2/17 with effective date of 10/16/17, general denial issued to applicant 10/10/17, IME signed and dated 10/16/17. I'm leaning toward holding the denial is effective since the effective date of the IME cut off is 10/16/17 which is the date the IME was signed and dated.
